Abstract

Penelitian ini berfokus pada penelitian hukum noramtif (yuridis normatif). Sumber penelitian yang ditulis dalam penelitian ini ialah data primer dan sekunder, dalam penelitian ini menghasilkan legalitas double profesi antara Peraturan Kapolri No. 2 Tahun 2017 tentang Tata Cara Pemberian Bantuan Hukum oleh Kepolisian Negara Republik Indonesia, yang bertentangan dengan UU No.18 Tahun 2003 tentang Advokat, berdasarkan Pasal 3 yang mengatur bahwa syarat untuk menjadi penasehat hukum antara lain tidak berstatus pegawai negeri atau pejabat negara. Anggota Polri menjalankan double profesi sebagai anggota Polri dan penasihat hukum. Padahal sudah jelas bahwa Perkapolri bertentangan dengan undang-undang tentang advokat, Nomor 12 Tahun 2011 tentang Hirarki Perundang-undangan dan KUHAP.
